By accessing and using this site (the “Site”) you (“you” or “End User”) (i) represent that you are an authorized representative of a company that is an existing client of Infused Industries. (“Client Company”), and that such Client Company has an On Demand or Software-as-a-Service agreement with Infused Industries (the “Service Agreement”) providing access to its software products via the internet or other network methodology (collectively, the “On Demand Services”); and (ii) agree to be bound by the terms of this On Demand Services Privacy Policy and to comply with the terms of the Client Company’s Service Agreement with Infused Industries (“Infused Industries,” “we,” “us,” or “our”).
We have created this On Demand Services Privacy Policy because we know that you and your Client Company care about how information and data you provide to us online pursuant to the Service Agreement are collected and used. This On Demand Services Privacy Policy relates to the privacy practices that Infused Industries uses when providing On Demand Services to our Client Companies.
Safe Harbor CertificationInfused Industries has developed global information practices designed to address Hosted Data (defined below) collected from End Users and Client Companies pursuant to our Service Agreements.
In light of the international nature of our business, our privacy practices are self-certified to the Safe Harbor Program agreed to by the US Department of Commerce and the European Commission. This On Demand Services Privacy Policy is consistent with Infused Industries’s participation in the Safe Harbor. Hosted Data“Hosted Data” is defined as (i) data that we host on behalf of our Client Companies pursuant to the Service Agreements for On Demand Services; and (ii) information that End Users and/or Client Companies voluntarily provide through the “Client Login” support portal accessible through our www.infusedindustries.com website or other infused industries sites. This On Demand Services Privacy Policy applies to the personally identifiable Hosted Data that may be provided to or accessed by Infused Industries online in connection with providing these On Demand Services.
How We Collect and Use Hosted DataHaving contracted with Infused Industries for On Demand Services, End Users and Client Companies will provide Hosted Data to Infused Industries. Infused Industries treats such Hosted Data as confidential in accordance with the terms of the Service Agreement.
Infused Industries will process and/or store such Hosted Data, but does not control Client Companies’ information collection or use practices related to Hosted Data. Infused Industries has no liability for Client Companies’ practices, including any failure to provide any appropriate notice and/or obtain any appropriate consent prior to transferring Hosted Data to Infused Industries. Infused Industries makes no independent use of the Hosted Data outside of what is needed to provide the On Demand Services.
Below we set forth the conditions under which we may access and/or use Hosted Data:
- Provision of Services and Support Requested By Client Companies. Infused Industries will access and use Hosted Data as required to fulfill its contractual obligations under the Service Agreements or subsequent requests for service and/or support by our Client Companies. In so doing, Infused Industries may outsource to third parties the On Demand Services or other services, in whole or in part, from time to time.
- Maintenance and/or Upgrade the System. Infused Industries’ technical staff may require periodic access to Hosted Data to monitor system performance, test and fix systems, and develop and implement upgrades to systems. Any temporary copies of Hosted Data created as a necessary part of this process are only maintained for periods of time relevant to those purposes.
- Legal Requirements. To the extent permitted by law, we may also disclose Hosted Data when required by law, court order, or other government or law enforcement authority or regulatory agency, or whenever we believe that disclosing the Hosted Data is necessary or advisable, for example, to protect the rights, property, or safety of Infused Industries or others.
We maintain reasonable physical, electronic, and procedural safeguards to secure the Hosted Data from loss, misuse and unauthorized access, disclosure, alteration, and destruction. In addition, we use standard security protocols and mechanisms in the transmission of sensitive data.
Important Notices to Non-U.S. ResidentsInfused Industries abides by the principles set forth in the Safe Harbor framework as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of data from the European Union. However, it is important to note that the servers that store the Hosted Data are operated in the United States. If you are located outside of the United States, please be aware that any Hosted Data provided to us will be transferred to the United States. By participating in Infused Industries’s On Demand or Software-as-a-Service services, you consent to this transfer.
In order to comply with the Safe Harbor framework, Infused Industries commits to the resolution of complaints about your privacy and our collection or use of Hosted Data. We have committed to resolve any complaints by European Union citizens relating to this On Demand Services Privacy Policy, which cannot be resolved directly with our company, through the Council of Better Business Bureaus, Inc.’s Safe Harbor Privacy Dispute Resolution Procedures.

We may change this On Demand Services Privacy Policy from time to time. By accessing this Site after we make any such changes to this On Demand Services Privacy Policy, Client Companies and End Users are deemed to have accepted such changes. Please be aware that, to the extent permitted by applicable law, our use of Hosted Data is governed by the On Demand Services Privacy Policy in effect at the time we collect the Hosted Data.
